Description: December 13, 1995 Chairpersons General Committees of Adjustment Railroads in the United States United Transportation Union Dear Sirs and Brothers: Attached you will find a copy of the rates of pay effective January 1, 1996, resulting from the application of the 7 cents per hour cost-of-living allowance (COLA) provided for in Article II, Part B, Section 1 of the November 1, 1991 Implementing Document. The COLA produced by the formula contained in the Implementing Document resulted in a 9 cents per hour payment, however, 2 cents per hour was subtracted as the employees share of the carriers' increased cost of the 1996 payment rate for foreign-to-occupation (FO) health benefits under The Railroad Employees' National Health and Welfare Plan. You will find attached a copy of a letter addressed to CRLO Chairman M. A. Flemming from NRLC Chairman R. F. Allen setting forth the formula used in arriving at this offset. These conclusions were reached following discussions with representatives of the MetraHealth Insurance Company regarding, among other things, the amount of the carriers' 1996 payment rate for foreign-to-occupation ("FOil) health benefits under The Railroad Employees National Health and Welfare Plan (the "Plan"), as that rate is defined in the applicable collective bargaining agreements. The conclusions reached were: The above conclusions, and your concurrence with them, are without prejudice to any position that may be taken by either the carriers or the labor organizations in connection with the formulation or calculation of any aspect of COLAs in the future.
