ITEM 1b - CAR RETARDERS
Description: ITEM 1(b) AGREEMENT CAR RETARDERS Section 2(d) of the agreement between the Union Pacific Railroad Company and the Brotherhood of Railroad Trainmen "Car . Retarders" dated May 27, 1948 reads as follows: “When a position of car retarder is temporarily vacated, the senior yardman qualified as a car retarder on that shift will be used, but if there are no qualified car retarders on that shift, the first out yardman on the extra board who is a qualified car retarder will be used. If the vacancy is not filled as outlined above, the senior yardman on-the other shifts qualified as a car retarder who has signified in writing his desire to work as car retarder will be used. Failing to secure a qualified car retarder from the above sources, the junior qualified car retarder will fill the vacancy. The company will not be required to pay penalty time when yardmen are used as car retarders to fill vacancies as indicated In this section.” It is agreed that the following will be added as an exception to the above: “When a known vacancy of ten days or more on position of car retarder operator occurs, the senior qualified operator, regular or extra, making application for the vacancy to the supervisory officer. North Platte, will be placed thereon. When the regularly assigned incumbent returns to work he will be required to take the assignment he previously held, unless there has been a vacancy on the position of car retarder operator bulletined during "The regular or extra car retarder operator filling the vacancy will return to his former assignment, extra board, or exercise seniority on vacancies occupied by junior car retarder operators. "In the event no applications are received, the vacancy will be filled in accordance with the first paragraph of Section 2(d)." This agreement will become effective August 15, 1957 and will supersede the supplemental agreement dated July 15, 1955 modifying Section 2(d) of the agreement dated May 27, 1948.
