Road Meal on Non-Interdivisional Service

Your claims:

• When you are called off road boards for other than Interdivisional service.
• Agreement language is for “reasonable amount of time”.
• If denied lunch period, claim 130 mile basic day.
• It is recommended that you make the request for a meal period to the dispatcher or manager at the beginning of the shift. 

Required Documentation:

• A complete copy of your federal tie-up.
• Manager/Dispatcher/Corridor name and time that lunch period request was made and time it was denied.
• A copy of your denied non-service claim.

EXAMPLE:

Denied Meal Period:

CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED TO EAT FOR ENTIRE TOUR OF DUTY. WAS CALLED ON DUTY FOR _(job) AT ____ HRS ON (Date) . AT _____HRS REQUESTED MEAL PERIOD. AT ________HRS WAS ORDERED PER (dispatcher/yardmaster/manager’s name) , THAT I WAS NOT TO TAKE A MEAL PERIOD FOR ENTIRE SHIFT. CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED MEAL PERIOD IN VIOLATION OF RULE 22.

Not Allowed Reasonable Time:

CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED A REASONABLE AMOUNT OF TIME FOR A MEAL PERIOD.  WAS CALLED ON DUTY FOR (JOB ID) AT ______HRS ON ______(DATE).  AT ______HRS WAS INSTRUCTED BY (DISPATCHER/MANAGER) TO TAKE ONLY _____MINUTES FOR LUNCH.  DUE TO THE UNIQUE CIRCUMSTANCES OF THE ASSIGNMENT, _____MINUTES WAS NOT AN ADEQUATE NOR REASONABLE AMOUNT OF TIME.  CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED A MEAL PERIOD AS ALLOWED IN RULE 22.
