Set-Back Engineer Seniority Restriction Claims (3x)

If set-back engineer was forced to work as an Engineer and you would/should have been assigned to their vacant position, but was not due to cut back Engineer not being assigned to an Engineer position (e.g. Set back Engineer was forced to work off their current Conductor assignment as an Engineer but was not picked up as an Engineer and you were the senior applicant to their current Conductor assignement):

Your claims:

  • When set back Engineer is forced to work as an Engineer and you were not added to the the vacant slot that would have occured on their Conductor assignement.
  • Claim is for a seniority restriction due to that person not being added back as an Engineer and their current Conductor assignment not being assigned to the senior applicant.

Documentation:

  • A copy of the applicable engineer seniority roster showing their ranking.
  • A copy of the board snapshot in seniority order.
  • A copy of your JOB HISTORY showing what you were actually working a different assignement on the date the Claim is being made.
  • A copy of the JOB HISTORY showing what the set back Engineer was actually working when forced by CMS to an Engineer assignment on the date the Claim is being made
  • If claiming difference in earnings, must include a copy of your e-payroll recap with notes demonstrating the amount actually made for the date range being claimed vs. what you would have made on that assignment had you been properly picked up to the newly vacnt position.
  • A copy of the standing bid list if applicable.

Claiming a basic day penalty account CMS Mishandling in restriction of my seniority. On (date) at (time) hrs. I was not picked up on (CIRC-7, Board ID and postion) when (Cut Back Engineer Name) forced to work as an Engineer on (Circ-7, Job ID) on (Date and Time) when holding a position as trainman. I am currently working as a trainman and was on the (Circ 7) (Board). Claim 130 mile basic day at Conductor rate of pay for not being picked up as I was the senior applicant.

 

If a set-back Engineer was used and you are senior to said Engineer and should/would have been used as an Engineer, but was not due to a seniority restriction.

  • When a junior set back Engineer is forced to work as an Engineer and you were not used although you were the senior reduced Engineer.
  • Claim is a basic day for a seniority restriction.

  • A copy of your JOB HISTORY showing what you were actually working on the date the Claim is being made
  • A copy of the junior Engineer’s JOB HISTORY showing what they were actually working on the date the Claim is being made
  • If claiming difference in earnings, must include a copy of your e-payroll recap with notes demonstrating the amount actually made for the date range being claimed vs. what you would have made as an engineer had you been properly picked up.

Claiming a basic day penalty account CMS Mishandling in restriction of my seniority. On (date) at (time) hrs. (Junior Engineer) was forced to work as an Engineer when holding a position as trainman. I am currently working as a trainman and was on the (Circ 7) (Board). Claim 130 mile basic day at engineer rate of pay for nt being properly recalled in seniority order.

  • Claim is for a seven basic days for CMS Mishandling/seniority restriction.

  • A copy of the board snapshot in seniority order.
  • A copy of your JOB HISTORY showing what you were actually working on the date the Claim is being made
  • If claiming difference in earnings, must include a copy of your e-payroll recap with notes demonstrating the amount actually made for the date range being claimed vs. what you would have made as an engineer had you been properly picked up.

Claiming a basic day penalty account CMS Mishandling in restriction of my seniority. On (date) at (time) hrs. I was forced to work as an Engineer when holding a position as trainman. I am currently working as a trainman and was on the (Circ 7) (Board). Claim 130 mile basic day at engineer rate of pay for seven days as per Engineers Guaranteed Extra Board Agreement as I should have been added to the GEB and not reduced therefrom for a period of seven days..

* Can also claim difference in engineer rate of pay for the date range if it would have been higher.

 

If you are a set-back Engineer working as a trainman and were forced to work as an Engineer but were not the senior reduced Engineer.

Your claims:

  • When you are a set back Engineer and forced to work as an Engineer but are not the senior reduced Engineer.
  • Claim is for a basic day penalty for all days worked as an Engineer at the Engineer rate of pay for CMS Mishandling/Seniority Restriction.
